If any monies withdrawn are not used for Qualified expenses, the earnings portion of the Distribution is subject to federal income tax (at the Distributee’s rate), and an additional 10% federal penalty, and any applicable state and local income taxes.  Disability of the Beneficiary is one of four exceptions to the 10% federal penalty.

If the investor contributes less than the $75,000 maximum, additional contributions can be made without incurring federal gift taxes, up to the annual gift tax exclusion of $15,000 per year.  Federal gift taxation may result if a contribution exceeds the available annual gift tax exclusion amount remaining for a given beneficiary in the year of contribution, if the investor has used up his/her unified estate and gift tax credit.  The Unified Credit against Estate Tax for 2019 is $11,400,000, per person, is adjusted annually for inflation, and sunsets on December 31, 2025.
